Q.4) You are the Superintendent of Police (SP) of a district. There are different complaints of corruption and tempering of evidence against an Inspector of Police who is your subordinate. When asked, he initially denies but in the end accepts all these charges against him. Also, with evidence he proves that, he takes bribe and uses that to support poor and needy. He gives donation to a local orphanage. Also, he takes bribe only from rich law-breakers who have money power to come out clean if complaint is filed against them. Without registering cases, he helps victims by bringing justice to them outside law, because the perpetrators use money and muscle power to evade the cases. (a). What are the Ethical issues involved in the case? (b). How will you respond to the charges against him? Give arguments supporting your response. (20 Marks)

      Stakeholders identification is fine but you must understand the purpose behind their identification. It’s just so that One can use issues related to each in your answers.

      You need to write more Issues like unethical means ( bribe corruption and forced conciliation) to achieve noble cause ( helping poor), likes are treated alike for crime, trust of public in public institution will hamper from this incident, Dereliction of duty and dharma, lack of fear in mind of criminal and shoddy state of justice system and lack of justice to poor etc.

      You need to write what actions will you take. Just writing that you’ll take action is not enough. Clearly write. A Report should be prepared of all those cases where he took bribe to let go perpetrators without
      punishment. FIR should be registered against him for misuse of public office division of duty
      corruption and bribery.
      Let the court handle the case and decide quantum of punishment for him.
      Till the case in court should be suspended from office.

      According to the SC In India every one has a right to privacy, even criminals. and as being an officer of law you must respect that. Further it’s your responsibility to take actions against guilty there is no need to publicise it.

      In justification you can take backing of the Indian constitution, scriptures like Gita and Gandhian philosophy of noble means.

      Last Section about donation is innovative but using organisation which have expertise like NGOs can be a better option rather then investing police resources which is already very stressed.

      Conclusion is well articulated.

      You have Written too much in your answer but gave incidental glimpses of what is asked in the question.

      In first question you had to write about the Ethical concerns in the case as a whole not ethical dilemma faced by anyone. Both of these terms are different. If you dont know the difference read about it.

      In the next Section question didn’t asked you to evaluate options available to you. Rather here you had to write your course of action and then justify it with Ethics based Arguements.

      You are posted as SP and you have enough authority to take action against a corrupt Officer.

      Course of action- A Report should be prepared of all those cases where he took bribe to let go perpetrators without
      punishment. FIR should be registered against him for misuse of public office division of duty
      corruption and bribery. Let the court handle the case and decide quantum of punishment for him.
      Till the case in court should be suspended from office.

      Use arguments based on Constitution, Gandhian philosophy of noble means, principal of natural justice to justify your action.

      Read question carefully. And write what is asked.

      Ethical concerns are different from ethical dilemma here you need to point out various ethical issues involved. Add issues like unethical means to achieve noble cause, rule of law hampered and likes are treated alike for crime, trust of public in public institution will hamper from this incident etc.

      In case study you should stick to what is given in the case do not presume things on your own. There is no senior involve if it’s not given in the case.

      Here your subordinate officer is in conflict with law. Here you need to take actions against him and you need to justify your course of action based on various ethical arguments.

      Try to write brief introduction you can summarize the case study here or use same facts or reports which highlights the issue raised in the case.

      You have Written issues section well. In last two points your content is fine but headings you have given are not appropriate.
