Q.2) What are the various guidelines laid by the Supreme Court in the migrant labourers case? What are the various challenges in implementing the guidelines? Suggest the way forward to overcome these challenges. (10 Marks)

  • In the body mention various guidelines laid down by the Supreme Court such as food and travel arrangements, no insistence on identity cards, implementation of “One nation, one Ration Card” direction to the State governments to run the community kitchen, directive for National Database for Unorganised Workers etc. In the challenges mention administrative problems such as difficulty in covering migrant workers as they keep moving, lack of infrastructure in some states to run and maintain community kitchens, lack of data to identify eligible migrants. In the suggestions mention updating National Database for Unorganised Workers, developing standardised system for identification of beneficiary, States working closely with the Centre etc.
  • Conclude by mentioning that it is imperative to ensure that government machinery works to its full potential and robust systems are developed to withstand the challenges that looming third covid19 wave poses.

      Introduction is good. After guidelines of SC, mention challenges in implementation first, then you can mention briefly steps taken. Then way forward.

      In directions given also mention that states were asked to arrange for transportation, right to food was affirmed under article 21, recognised the need for direct cash transfer, asked labor ministry to ensure updation of national database of unorganized workers.

      Issues mentioned are fine, write a seperate way forward. Guidelines, challenges in implementation and way forward have been exclusively asked, so these 3 section should be clearly visible. After that if you are left with space and word limit you can adjust some other points too.

      Conclusion is okay, you can also mention about looming challenge of 3rd wave.

In directions given also mention that states were asked to arrange for transportation and food, right to food was affirmed under article 21, recognised the need for direct cash transfer, asked labor ministry to ensure updation of national database of unorganized workers.

      Challenges mentioned are fine, you can add that guidelines are not mandatory, depend on state’s conscience.
      In way forward also mention the need of cooperation between centre and states.
      Also very briefly you can mention some of the steps government has taken to solve the issue.
      Conclusion can be framed better, many guidelines are yet to be implemented, so saying that they already helped doesn’t sound proper.

      In introduction, instead of 2nd wave you can mention the reverse migration witnessed when lockdown was announced last year.

      In guidelines also mention that SC asserted right to food under article 21, one nation one ration card deadline fixed, identity verification relaxed, recognised the need for direct cash transfer.

      In challenges you can mention that guidelines are not mandatory and depend on state’s conscience. Rest of the points are fine.

      Way forward and conclusion is good. Examples are good. You can also mention some of the government initiatives taken under Atmanirbhar package.

      Way forward is missing. Need to mention, core demand of question. Mention about the need to update national unorganized workers database, rectify errors of inclusion-exclusion, infrastructure development for kitchens etc

      Also you can give examples of some of the schemes announced under Atmanirbhar package in this regard and some state government schemes.

      However, no need to mention government initiatives part in such detail, you can use some points in way forward.

      Rest of the answer is good. Updation of National database for unorganized workers was a directive of the court only.You can mention that there.

      In challenges also mention about difficulty in establishing community kitchens at a large scale, no guidelines for direct cash transfer also.

      Intro, conclusion are good.
